first_imgCourt hears PWP arguments Court hears PWP arguments YLD wants all new lawyers to take the professionalism course Gary Blankenship Senior Editor Requiring all lawyers, including government attorneys, to take the Practicing With Professionalism course, would establish a basic level of professionalism with all Bar members, according to the Young Lawyers Division.The YLD presented its case for amending the Practicing With Professionalism Rule to the Supreme Court in oral argument January 11. Its petition was largely supported by the Government Lawyer Section and the Florida Public Defender Association, who said they would like to see some minor language changes.The Florida Prosecuting Attorneys Association and others opposed the rule, saying either it wasn’t needed or it would interfere with similar programs offered by other groups.Currently, all new Bar members are required to take PWP within their first year after admission, except those working for government agencies. They are allowed to defer taking the course until they leave public service.The most controversial part of the rule change would end that deferment for government lawyers. The change would not be retroactive and government lawyers with six or more years of Bar membership would not have to take PWP if they left for private practice.Former YLD President Mark Romance — responding to a question from Chief Justice Barbara Pariente on why PWP should supplant programs that prosecutors, public defenders, and others already have for their new Bar member-employees — said there cannot be too much professionalism training and that other courses were often specific to only certain types of practice.“The PWP course is specifically designed to provide an introductory level course on professionalism ethics, the rules that apply. . . to all,” Romance said. “The Florida Bar has the goal of providing a uniform and universal introduction to the concept of professionalism and ethics, right at the beginning of a member’s admission to The Florida Bar.”He added that for financially strapped new lawyers, the division is offering a $75 scholarship toward the $135 PWP cost. He also said agencies such as the state attorneys and public defenders could still offer courses specifically geared to their ethical needs.Keith Rizzardi, past chair of the Government Lawyer Section, said the section and division had extensive discussions and negotiations over the deferment elimination. He said the section is satisfied that the course will be beneficial to government lawyers and won’t cover practice tips that are helpful to private practitioners but not government lawyers, as did earlier courses.“After sending our members to the program and looking at the program and evaluating the program, we realized that what was at issue here was whether or not The Florida Bar should allow a shared common experience for all new lawyers,” Rizzardi said, adding the section was satisfied the program would be useful to government lawyers and the $75 tuition reduction would help those on tight budgets.The section’s concerns, he said, are that the grandfather exception for current government lawyers is in the comment to the rule rather than in the text of the rules and that lawyers must attend one of the seminars rather than having the option of viewing it on videotape. Rizzardi said government lawyers could view the videotape in groups and have the same type of interaction and discussions as lawyers attending the live presentations.Justice Harry Lee Anstead said, though, that could lead to abuses where someone merely listens to a tape while driving.Rizzardi also said the section supports the continued exemption of government lawyers from taking two more basic skills courses offered by the YLD during a new lawyers’ membership, as those courses are aimed at private practice issues.“This is one class, one day, and a $75 tuition reduction,” Rizzardi said. “We were willing to accept that compromise.”Second Circuit Public Defender Nancy Daniels, representing the Florida Public Defender Association, told the court that while “not enthusiastically supporting the change, we accept it. We think on balance our lawyers will be well-served by a basic professionalism one-day course.”The association’s concerns, she said, are that it have input into the PWP course, that some of the course focus on the unique needs of criminal law, and whether the $75 tuition reduction will be widely available. Daniels added that the YLD has included the public defenders in its planning.Buddy Jacobs, representing the Florida Prosecuting Attorneys Association, said the requirement is unnecessary for new prosecutors because the association already has an “excellent” course that is used statewide. Jacobs said it would be redundant to send new prosecutors to the YLD course.He also noted while the Government Lawyer Section negotiated with the YLD, the association didn’t and most of the 1,700 or so assistant state attorneys in Florida don’t belong to the section.Justices said they were concerned if they exempted the prosecutors, other groups would want their own professionalism programs for new members. That, they noted, could involve the court in micro managing to determine which courses were worthwhile and which weren’t.“It would really be of assistance, I think, if the Florida Prosecuting Attorneys Association and The Florida Bar and the Young Lawyers Division actually talked to one another,” Chief Justice Pariente said. “Maybe there are some suggestions. . . and I can see lots of ways that this whole thing could be mediated out.”Tony Musto of Hallandale, representing himself and several other lawyers, argued that the YLD’s Web site still lists many law-office practice issues as being taught by the course, and those are the things that should be deferred for government lawyers until they enter private practice. He expressed concern that the while PWP had a new title, it still reflected past times when it was more private practice oriented.“I would suggest to you that the purpose of this course has been, and should be, focused on the business side of the practice of law, and that’s why government lawyers should take it when they come out [of public service],” Musto said.Justices, however, noted other filings showed the course would only cover professionalism.
